ALTERNATIVES TO THE EXCLUSIONARY RULE The continuing debate about the exclusionary rule has produced several proposals to admit the evidence obtained and then to deal with the wrongdoing of the police. Among the proposals are the following: _ An independent review board in the executive branch. This proposal envisions a review board composed of nonpolice personnel to review allegations of violations of constitutional rights by the police. The problem with this alternative is that police oppose it because it singles them out among public officials for differential treatment. Moreover, outsiders are viewed by the police as unlikely to be able to understand the difficulties and dangers inherent in police work. _ A civil tort action against the government. This would mean filing an action seeking damages from the government for acts of its officers. The proposed good faith exception covers all cases in which the police would claim and can prove that they acted in good faith (not just when the magistrate issues an invalid warrant). It is based on two conditions: (1) The officer must allege that he or she had probable cause for the action in question, and (2) the officer’s apparent belief that he or she was acting legally must be a reasonable one. These are questions of fact that will be determined by the judge or jury. Opponents fear that this proposal would lead to more violations of rights using good faith as a convenient excuse. Good faith is a vague concept that is best determined on a case-by-case basis; it may therefore vary from one judge or jury to another. It is also maintained that this exception discourages training and rewards lack of knowledge. The Trinity in The Inferno      Ã‚  Ã‚  Ã‚   Dante's Inferno, itself one piece of a literary trilogy, repeatedly deploys the leitmotif of the number three as a metaphor for ambiguity, compromise, and transition. A work in terza rima that details a descent through Nine Circles of Hell, The Inferno encompasses temporal, literary, and political bridges and chasms that link Dante's inspired Centaur work between the autobiographical and the fictive, the mundane and the divine and, from a contemporary viewpoint, the Medieval and the Modern†¹Dante's recognition of the Renaissance as our millennium's metamorphic period and of himself as its poetic forerunner (until deposition by Shakespeare).    The Inferno is a work of transition between two points, as attested by the opening lines: "When I had journeyed half of our life's way,/ I found myself within a shadowed forest,/ for I had lost the path that does not stray" (I, 1-3). Echoes of these famous lines can be heard in Robert Frost's "The Road Less Traveled"; whereas Frost's poem concerns itself with the duality and firmness of decision, Dante's tercet implies an interval of great indecision and limbo. Indeed, he is anything but entrenched in position: "I cannot clearly say how I had entered/ the wood; I was so full of sleep just at/ The point where I abandoned the true path" (I, 10-12). Dante is nearly sleepwalking, yet another fusion of two worlds, the conscious and unconscious. This division of self can best be explained by Dante's exile and his loss of national identity. Byzantine painters and Jacob narrates the same story with different style of painting and in different period. Both painters strove to make utterly convincing an emotionally charged realization of the theme. Both artists presented lamentation scene in more a natural setting and people in the image are fully modeled. They included crying Mary and other religious representation to tell their audience the story is taken from bible. Both painting share the same biblical subject yet differ in a significant ways that show their respective embodiments of the 12th and 16th century styles. Byzantine painter presented their work on the wall painting style in the church, which is one of the oldest in Macedonia and was built and painted in 1164 under the patronage of Byzantine prince Alexios Komnenos. The church is most famous for it's exceptional fresco paintings, which convey dramatic facial expressions and emotions not commonly found in Byzantine art. It was dedicated to saint Panteleimon. Byzantine painters embellished the church of saint Pantaleimon with murals of great emotional power. One of these, Lamentation, is a paint of passionate grief over the dead Christ. This scene actually represents a novelty in Byzantine wall painting because of its dramatic realism. This masterpiece narrates the history in a New Testament. Central place in the composition of the drama takes Christ while Joseph Arimatean, Nicodemus, Mary, and John are participant. Holy mother of God kissed the dead face of Christ, Joseph supports the body of Christ, John, who is the beloved apostle of Christ, bent down and he took Jesus hand to put it on his face, and Nicodemus who kneeled and with both hand he hold the pliers with which retrieves nails of the feet of Christ nailed to the cross. The painting shows their attitudes, expressions and gestures of sadness. Symbol of the Virgin Mary to her dead son is handed realistic, real-life scene shown, with an emphasis on human feelings. She is closest to Christ body than other Jesus followers shown on the image. She put her right hand under Christ neck and the other hand just below his chest. She put her face against her dead son. Looking at her face, I can see she is quit emotional and cannot hide her feeling and grief instead she showed it by crying. John, who was the Christ disciple, also shows his deep feeling and sadness through his facial expression. The body of dead Christ also clearly shows he is dead. His body is proportional, slim and relaxed and his eyes are closed which reveal he is dead. The image of dead Christ doesn’t show his suffering clearly. His body is muscular and clear of any wound. The wall above this scene is painted with blue color, which represents the sky color. In the sky there are angles watching over dead Christ. The main focus of the painter of this masterpiece is the lamentation, which describes the deep emotional feeling of Christ followers because of death. The actor in the picture showed emotional impact of Christ’s death for viewer. On the hand, the Holland woodcuts and painter of sixteenth century called Jacob Cornelisz Van Oostsanen presented the same scene with significantly different way. This work was painted using tempera and oil on panel. In the byzantine painters primary attention is the lamentation of Christ and the emotion of his followers but here in the Van Oostsanen’s the emotional outpouring of Mary and Christ’s disciples seems secondary to the attention paid by the artist to the fashionably ostentatious headdresses and billowing drapery depicted here. He added little to show the painting’s emotional impact. Even though byzantine painters are good in showing the emotional impact they did not clearly show the sign were Jesus was nailed on the cross. Van Oostsanen, on the other hand, showed the sign were Christ was nailed to the cross. The Van Oostsanen paint is more decorative with clothing and building style, which overshadow the emotional expression due to the scene. On the back of the painting there are two crosses one with person on the cross and the other cross is without a person and the ladder is inclined against it. The empty ladder is where Jesus was crucified. Most of the actors in this painting are not emotional and Mary is crying but not really emotional. The skin color of this painting is more realistic than the byzantine painters used. In Van Oostsanen’s painting the face of the actors are little disproportionate. They have small and circular face. In byzantine painting Mary is very closely touching her son, however in the van Oostsanen painting she is sitting away for her son body and hold her son hand. The angles are also presented in the byzantine painting but in Van Oostsanen there is no angle representation. There is small figure in the lower left, which may represent the person who commissioned the painting. In general, the painter was so talented and able to bring the picture alive with innovative movements, luxuriant, drapery, and careful balancing between relaxation and tension. Just like Van Oostsanen painting, Byzantine artist also showed the event around them through engraving to offer visual proof of emotion of human affection. The two painting are well done to show the lamentation of Christ. Although these artworks are done in different location and period, there are huge similarities in telling the biblical story. Critical Summary of Conflicts as Property Essay

Introduction The article I will be critically summarizing is â€Å"Conflict as Property†. It is an influential article written by the criminologist Nils Christie in the late 1970s. Throughout the entire article Christie argues â€Å"criminology to some extent has amplified a process where conflicts have been taken away from the parties directly involved and thereby have either disappeared or become other peoples property†1 This statement is what I have found to be Christies thesis in which all of his points refer back to. Christies Argument Throughout the article Christie reflects on why he believes the conflict between two parties, the victim and defendant has been â€Å"stolen† by the authorities, the state, and by professionals. Christie said that not only does the victim loose his or her say in the proceedings but is relatively thrown out of the case in which it becomes between one party and the state. He found this unsatisfying and argued that it should be given back to the initial parties involved, the victim, the defendant and the neighborhood. He says when a conflict is created that we are less capable to take on the situation and are more likely to hand it off to some one else. This is where there is a lineup of professionals willing to take the conflict from us and we are just as willing to give it away. Christie explains his notion of â€Å"conflict as property† as not referring to material compensation but rather to the ownership of the conflict itself. He then recognizes the effects of victim losing the â€Å"property† initially and puts forth a method as a remedy for this process. He proposes a new court model for dealing with conflicts in which the court is victim centered and lay-oriented. My Opinion For most of the part I agree with what Christie has to say. I believe that throughout a proceeding it should be of most importance that the victim’s situation is to be heard whether it is relevant to the law or not. Instead of letting the state or professionals take over and say what they think has the most relevance to a case the court should hear the entire story from the victims point of view. This would show the courts to what affect this act by the offender has caused in the victims life. Also they should hear out what the victim seems fit as a fair punishment or payment in forms of restitution whether it is labour or monetary to go along with the judges sentence. I think that by having the initial parties involved instead of being pushed to the side, society will be more concerned to make sure that everyone is given a fair, equal, and consistent resolution to a conflict. It would ensure that the neighborhood and state have the same set of shared values and goals that the y are working towards to support social order. Most offenders after committing crimes do not want to see the victims or their families that they affected. It is an emotional encounter in the courtroom where the offender can show his remorse and the victim(s) can show pity I think that the two types of segmentation that are observed in our highly industrialized societies are the most important factors in why we don’t have the ability to deal with conflict. The segmentation in space is how we go through our daily lives and not recognizing any of the people we see as who they are but by what they do. Secondly we segregate people based on their physical attributes such as race, gender, and sex. This segregation has many consequences on society as a whole. The most influential consequence that we experience is depersonalization as Christie said. Not having this person-to-person relationship is detrimental, especially when conflicts arise seeing as how we can’t deal with them between the parties involved. We need professionals to step in and take the roles from us, which results in us being cast aside. Conclusion â€Å"Except for execution, castration or incarceration for life, no measure has a proven minimum of efficiency compared to any other measures†2 instead of continuing with the traditional way of a legal proceeding we need to change  things. People need to be able to interact face to face and have a more personal interaction. Conflicts must be given back to the initial parties and not â€Å"stolen† by these other powers. The preliminary works for Phase I will take about 12 months, including pre-sales of apartments and collection of deposits. The construction period is expected to be 30 months. Phase II will involve 177 units in a 35-storey tower and Phase III will involve 263 units in a 45-storey tower. Phase I of the project is based on an average construction cost of Rs9,030 per sq.ft while the average selling price is expected to be Rs25,800 per sq.ft. The construction will only commence upon reaching secured sales through deposits amounting to 50% of the construction cost by sales value. The capital required for Phase I is Rs650mn (Rs235 mn being in cash and Rs415 mn being land value) where the cash is sufficient to cover consultants fees, marketing expenses and CMC fees during the first 12 months, up to push-button. That is, I wrote down (as one might write down music) the inadvertent sounds made by the students as they wrote the test. Such increased demand has been observed to cause amplified electricity generation (Grimmond 87). This, in turn, results in the production of more greenhouse gases in the atmosphere, which again leads to intensified global warming (Grimmond 87). With the continued abuse by people of the environment and the continued generation of heat, risks greater than the heat waves experienced in many countries are very likely to arise (Grimmond 87). It may be considered that the contribution of urban development and urban warming to the global scenario is small; however, the dangers tat urban warming poses should not be ignored (Grimmond 87). Gases from urban areas, such as pollution and greenhouse gas emissions are the leading anthropogenic sources of global warming (Grimmond 87). Global warming can also cause the loss of the Greenland ice sheet (King 780). This would cause serious problems because it could raise the sea level around the globe by approximately 7 meters over a period of about a thousand years (King 780). It could also cause enhanced retreat of glaciers in some places (King 780). Further effects of global warming can also be observed in the oceans, through increased acidity (King 780). The increase in carbon dioxide levels in the atmosphere cause a corresponding increase of the same in oceans, thereby increasing their acidity (King 780). Thus, there are already observed effects on coral reefs and plankton population, while wider impact on marine life and on the food chain is yet to be observed (King 780). To date, a documented total of 17 coral reef ecosystems have been found to be degraded around the world. This is a huge blow to the planet, since it is estimated that â€Å"coral reefs provide support to ecosystems worth more than $375 billion per annum to the global economy (King 780).† These terrible consequences should be enough to make everyone concerned about global warming and its deleterious effects on all aspects of life in the planet (King 780). People should be concerned about destroying life and support systems in different ecosystems, which would eventually affect human lives. Having seen the scary possibilities that come alongside global warming, everyone should join the movement towards making this planet greener and healthier. People should be moved by stories of forest fires, destruction of ecosystems, and deaths due to heat waves, that are occurring all over the world (King 780; Saxe, et al. 389). The planet is becoming less safe with each passing day that people live in ignorance of the damage they are causing the environment. Continuous apathy and inaction could lead to more catastrophic deaths and further destruction of the planet, which possibilities should raise alarm and concern in all mankind. Each person can definitely do his share in minimizing the anthropogenic causes of global warming. We have seen how a simple act of minimizing the consumption of airconditioning could have positive effects on the environment. It is time that each of us does our share to save our home. This is the only way that future generations could still enjoy earth as we know it.
